The Competition and Market Authority returns to shed light on the practices adopted by Italian e-commerce with the aim of preventing behaviors that result in damage to consumers. This time, the companies GPS Italia Srl and E-Commerce Specialist Srl and their sales activities carried out respectively through the websites www.ilrinnovato.it And www.hwonline.it.
BEHAVIOR CONTESTED: INVESTIGATIONS IN PROGRESS
Given that investigations are still ongoing and that at the moment no sanctions have been imposed on the two companies, the conduct under review by the Agcm includes various stages of online sales, in particular:
- publication of misleading information on product characteristics:
- delivery time
- packing method
- incorrect ways of the online sales process
- non-delivery of products
- obstacle to the exercise of the right of withdrawal and reimbursement
- inadequate after-sales service
Considering the seriousness of the conduct, the Agcm is evaluating whether or not to apply precautionary measures. The In fact, there is a risk that consumers will be misled, conditioned in purchasing decisions or hindered in the exercise of fundamental rights. It should be borne in mind that the sales examined by the Authority concern products paid in advance – even of a significant amount, it is specified in the official note – which are not delivered within the indicated times and for which no reimbursement of the amount already paid is received.
